1. Agreement to Terms

Welcome to Monday Tennis! These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Wave Tech LLC ("Company," "we," "us," or "our") regarding your use of the Monday Tennis mobile application ("App") and related services.

By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last Updated" date and, where appropriate, notifying you via email or in-app notification. Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.

2. Eligibility

To use Monday Tennis, you must:

• Be at least 13 years of age (or the minimum age required in your jurisdiction)
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the App under applicable laws
• Provide accurate and complete registration information

If you are under 18 years of age, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Account Registration and Security

3.1 Account Creation

To access certain features of the App, you must create an account using a valid email address. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to:

• Notify us immediately of any unauthorized access or use of your account
• Not share your account credentials with others
• Not create multiple accounts for deceptive purposes
• Log out of your account when using shared devices

3.3 Account Termination

You may delete your account at any time through the App or by contacting us. We reserve the right to suspend or terminate your account if you violate these Terms.

4. Use of the App

4.1 License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal mobile device for your personal, non-commercial use.

4.2 Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the App for any illegal or unauthorized purpose
• Violate any applicable laws, regulations, or third-party rights
• Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Impersonate any person or entity or falsely represent your affiliation
• Interfere with or disrupt the App or servers connected to the App
• Attempt to gain unauthorized access to any part of the App
• Use any automated means to access or collect data from the App
• Reverse engineer, decompile, or disassemble any part of the App
• Remove or alter any proprietary notices or labels
• Use the App to spam, harass, or harm other users
• Manipulate match scores or leaderboard rankings fraudulently

4.3 Tennis Groups

When creating or managing tennis groups, you agree to:

• Only add players who have consented to being part of the group
• Record match scores accurately and honestly
• Respect other players and group members
• Use group admin privileges responsibly

5. User Content

5.1 Your Content

You retain ownership of any content you submit, post, or display through the App ("User Content"), including group names, player names, and match data. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content solely for the purpose of operating and improving the App.

5.2 Content Responsibility

You are solely responsible for your User Content. You represent and warrant that:

• You have all necessary rights to submit the User Content
• Your User Content does not violate any third-party rights
• Your User Content complies with these Terms and applicable laws

5.3 Content Removal

We reserve the right, but not the obligation, to remove any User Content that violates these Terms or that we find objectionable, without prior notice.

6. Intellectual Property Rights

The App, including its original content, features, functionality, design, logos, and trademarks, is owned by Wave Tech LLC and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

The "Monday Tennis" name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Wave Tech LLC. You may not use these marks without our prior written permission.

You may not copy, modify, distribute, sell, or lease any part of the App or its content, nor may you reverse engineer or attempt to extract the source code.

7. Third-Party Services

The App may contain links to or integrate with third-party services, websites, or applications. We do not control and are not responsible for the content, privacy policies, or practices of any third-party services. Your use of third-party services is at your own risk and subject to the terms and conditions of those services.

The App uses third-party services including but not limited to:

• Apple App Store (for app distribution)
• Supabase (for backend services and data storage)

8. Disclaimer of Warranties

We do not warrant that:

• The App will be uninterrupted, timely, secure, or error-free
• The results obtained from the App will be accurate or reliable
• Any errors in the App will be corrected
• The App will meet your specific requirements

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

9. Limitation of Liability

Our total liability to you for any claims arising from your use of the App shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.

This limitation applies regardless of the theory of liability (contract, tort, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

10. Indemnification

You agree to indemnify, defend, and hold harmless Wave Tech LLC and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content

11. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination:

• Your license to use the App will immediately cease
• You must delete all copies of the App from your devices
• Provisions that by their nature should survive termination will survive (including intellectual property, disclaimers, limitation of liability, and indemnification)

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.

12.2 Dispute Resolution

Any dispute arising from these Terms or your use of the App shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved informally within 30 days, either party may pursue formal dispute resolution.

Any legal action or proceeding shall be brought exclusively in the state or federal courts located in Wyoming, and you consent to the personal jurisdiction of such courts.

12.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Wave Tech LLC regarding your use of the App.

13.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

13.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control.

14. Apple App Store Additional Terms

If you downloaded the App from the Apple App Store, the following additional terms apply:

• These Terms are between you and Wave Tech LLC only, not with Apple Inc.
• Apple has no obligation to provide maintenance or support for the App
• Apple is not responsible for any product warranties, whether express or implied
• Apple is not responsible for addressing any claims related to the App
• Apple is a third-party beneficiary of these Terms and may enforce them against you
• You must comply with applicable third-party terms when using the App
